Chronic Pain and Major Family Problems

I suffer from excruciatingly severe constant chronic migraine, but at least I have a great pain doc and the pain and nausea is controlled to the point where I can function at a basic level. I'm not well enough to work, though, and I no longer have enough 'work credits' to qualify for Disability. I also was diagnosed with Stage 2 breast cancer a few years ago.

My dad used to have a lot of money and he promised me that there would always be enough money for me to live on. Then the stock market crashed in 2008 and my dad lost a LOT of his money.

Even worse, I lost my dad a year ago in March 2014. It wasn't till my dad died that my mom and I found out just how little money was left, which left us both in a panic. My mom elderly and myself disabled. I have 2 older brothers and neither one of them gave us a dime, despite the fact that my parents did everything for them. They never visited. I am the only child who lived nearby and helped out my mom. My mom knew how ill I am and she arranged for me to inherit 100% of what little money was left.

March 2015: My greedy elder brother came out from Florida to visit my mom for 2 weeks. In reality, all my brother cared about was getting his hands on the money. My mom was elderly, and very vulnerable and confused about finances. She was dealing with the loss of my Dad and had never dealt with finances before.

My greedy brother used his visit to create more trouble than I ever could have imagined. My brother temporarily poisoned my mother's mind against me, telling her horrible lies about me and forbidding her to have any contact with me for a month. During this time, my brother secretly took my mom to a lawyer and had her change the Will to his favor. (My mom would have signed ANYTHING that anyone put in front of her).

My mom and I were best friends. My mom NEVER would have changed the Will if she'd been thinking clearly. My mom loved me and didn't want me to suffer. She had so much compassion for me and my illness. My brother is the greediest person I've ever known. He has NO compassion and he hates me. He is a millionaire, yet he still wanted to take away what little money I had left to live on??? I still cannot believe that one.

When this all happened in March, I called my OTHER brother, whom I've always gotten along well with. My 'good' brother told me not to worry too much. He told me, "I don't want any money. I know you're sick and I'd never take away the only money you have left to live on". My 'good' brother also promised me that he would 'stand up for me' against my evil brother whenever my mom did pass away.

In April when my greedy brother finally went back to Florida, I reconciled with my mom. Things were a little bit rocky at first, because my 'bad' brother had told my mom some outrageously hurtful lies about me in order to alienate her affections. My mom said all of these horrible things to me---out of nowhere. Then my mom apologized and told me "I'm so sorry. None of those things are true". My mom admitted that she was simply repeating all of the nasty things that my brother had said about ME. My mom admitted that she could not 'think for herself'. It was all very upsetting, but we reconciled.

My mom then wanted to change the Will back, but she didn't know how. I didn't know how to change it, either. I suggested we go to the lawyer that my 'bad' brother took her to, but my mom was under the impression that the Will was now 'set in stone'. (This must have been just another lie that my brother told my mom). I put in a call to the lawyer, but the next thing I knew---my mom was in the hospital.

I then stood vigil at my mom's side in the ICU for 3 weeks, while she slowly slipped away from pneumonia. She had been so healthy and it was so unexpected. My mom meant everything to me; I still can't believe she's gone.

I was (and still am) absolutely devastated. I knew my brother was a horrible person, but I never knew he was this low. I'm sick and I have no money, my brother is rich, I've just lost the mom who meant everything to me---and ALL my brother cared about was the MONEY! My brother took my inheritance, and there's not a darned thing I can do about it. My brother took that money and won't give me one dime.

My 'good' brother (who had promised to 'stand up for me' and who had claimed that he 'didn't want ANY money') NOW is pretending that we never had that conversation! I haven't received a dime from him, either, which is disappointing beyond belief!

There is NO other family, so there aren't any relatives who can mediate this dispute. I've lost my beloved mother, and my GREEDY brother keeps sending me more and more BILLS that I cannot afford to pay! Even worse, my greedy brother inherited a share of the house that my parents bought for me, so he's just waiting for me to go under financially so I'll be forced to sell my home and he can get EVEN MORE $$$! (My 'good' brother claimed that he would 'stand up for me' about the house, too, but he's done NOTHING. He's letting my bad brother get away with inheritance theft, and it's sickening to me).

My mom would be horrified if only she could see my brother enacting his cruel vendetta. One of the last things my mom said before going into the hospital was, "I have no idea what I signed". When I told my greedy brother this, he just smirked, as if he'd won a game or something. I'm dealing with horrible chronic pain AND devastating grief, AND every week or so my evil brother is getting his lawyer to threaten me with one thing or another OR send me yet ANOTHER bill to pay, when he's a millionaire and I am ill and have almost NO MONEY left.

I hadn't even spoken to or seen this brother in 20 years, due to the fact that he stole my parents' home 20 years ago. When my dad died a year ago, my mom was so lost and confused. I feared that this brother would come back into the picture to steal MY home and/or more money, and sure enough, I was RIGHT! He couldn't care less about my illnesses, even falsely claiming that I'm just a lazy liar who is feigning illness to avoid working. Yeah, right! That is SO offensive.

I'm also SO very disappointed in my 'good' brother. I genuinely thought HE cared about me. Back in March when the whole fiasco with the lawyer and the Will happened, my good brother told me, "Whatever little bit of pleasure the extra money would give ME wouldn't be worth it to me, due to the AGONY that NOT having the money would cause YOU". He also acknowledged that the inheritance was 'the ONLY money you have to live on for the rest of your life" and that my evil brother was a greedy monster to manipulate my mom's emotions for his own financial gain. How quickly people change due to $$$!

So my millionaire brother is literally taking away food, medicine, and shelter from his chronically ill sister. In my opinion, that is just plain EVIL. My 'good' brother has done NOTHING to help me, so I don't know that he's much better. WITH the (meager) inheritance money, I would be able to keep my lovely small home and just barely get by financially. WITHOUT the inheritance money, I will end up homeless, broke, unable to pay for food, medicine, etc.

I cry often about all of this. My mom and dad loved me and promised me that I'd always be provided for. For my greedy brother to manipulate my mom's emotions 3 months before her death and steal what little money I had left to live on is morally reprehensible. My greedy brother couldn't care less that I'm ill and enjoys inflicting pain and distress on me. He keeps threatening to sell my home for the $$$, and he is the trustee. Even though I inherited 50% of the house, my brother (as trustee) could still sell my house without my permission!

My 'good' brother has NOT done anything to allay my fears about the future. He hasn't given back ANY of the money that I was supposed to get, nor has he offered me shelter. He never even calls me to ask me how I'm doing---either physically, emotionally, OR financially. (My mom called me every single day. We saw each other every single weekend. I'm housebound and have no other visitors). When I try to talk about my problems to my 'good' brother, he replies, "I want to enjoy the beach". I can't believe anyone could be so selfish.

Thanks for reading this. How I envy people who have decent loving families!

I still cannot believe that my own 'brother' stabbed me in the back and wants to leave me penniless. He has $1.5 million---isn't that enough?? I can't even comprehend that level of greed or hatred. I know some people are greedy, but to do this to his own chronically ill sister?! It boggles my mind. Both my mom and my dad would be appalled, but now they cannot speak up or defend me from my brother's greed and cruelty. I'm devastated over this. This is the sort of thing that makes a person lose faith in human nature. I'm in so much pain, and the stress of simultaneously losing my mother AND my life savings is causing my pain levels to go out of control. This is all such a nightmare. So sad to lose the only people who loved me and had compassion for my pain---my Mom and Dad.

Eva your story is heartbreaking and if I were near your brother I would beat the crap out of him [even better I wish I had hacking skills] and take whatever I could to give to you. First thing is don't give up on the inheritance yet. Find a Lawyer that works with the poor and explain your story to him/her. If there is some medical files about your mom's state of mind then he could sue your brother to get back the inheritance. I know you feel overwhelmed right now but you have to fight for yourself and don't count on your brothers. I hope you check into a lawyer because I think you have a good case that could change things. Many lawyers take cases on the basis of a % of recovery so please check with the county for a lawyer for the poor or if you live near a university with a law school many senior students would look at your situation and tell you if you have a case.

Mark, thanks so much for your compassionate reply. This whole situation is such a nightmare.

I've done some research into the law and made a few calls, but it's looking like trying to get back the inheritance would be an uphill battle (at best) and would most likely cost thousands of dollars in legal fees. I know some lawyers work pro bono, but I'm afraid that I really don't have much documentation of the events that occurred with my mom and my brother. With my mom now unable to speak for herself, it would just be a 'he said, she said' sort of thing.

My mom was grieving the loss of my dad and she was very vulnerable because my dad had always handled all of the financial matters. My mom was emotionally overwhelmed. She was starting to get a little bit confused and forgetful (at age 78), but that's probably fairly common, particularly given the fact that she had just lost her husband of 55 years and had no experience with handling finances. I haven't seen all of her medical records, but I doubt that there's anything in there indicating dementia or anything like that. My mom was grieving and was under a lot of stress---I believe that's what her primary care doctor wrote.

I was able to get a copy of my Mom's prior Will, which does indeed say that she wanted 100% of the inheritance to go to me. My brother and his lawyer say that the new Will 'supersedes' the previous one, and I'm afraid that they are correct. I contacted my mom's financial advisor at the bank, and she admitted that while she knew that some 'weird' things had been going on with the Will in recent months, the changes that were made are permanent. She told me the prior Will has been superseded by the new one that my brother made my mom sign.

There really should be some legal safeguards in place to prevent this sort of inheritance theft. In my research, I've read a few similar stories online. One greedy sibling takes an emotionally vulnerable mom to a lawyer without informing the other siblings, tells Mom to 'sign here', and then nothing can be done to rectify the situation.

I knew how trusting my mom was, and I also knew that my brother had a history of stealing money from my parents (very hard to prove, though). I was afraid something like this was going to happen, but I'm still in shock that it actually DID happen. My brother is so rich, and I have almost nothing. That's bad enough, but then for him to do this to his chronically ill sister--WOW! Morally, it's a terrible crime. Legally, I don't think there's much I can do.

Thanks again for your reply. It means a lot to me.

      Best Wishes,
      Eva

Eva, I hope you get a lawyer to at least look at your situation. It may be as simple as her GP stating she didn't have full control of her decision making. If that comes before a court your brother would have to show prior problems with you mom's mind when the will had you as sole inheritor. Good Luck and I hope things work in your favor.

Eva - Having gone through the same thing with my family, Now all passed, I understand. FIND a LAwyer - if your mom was not competent when she signed the new will it is null and void. Hope this finds you better and I hape you get your inheritance back.
          Blessings
