This is about the cops towing a car. Let me fill you in 1st. Rick's dad lived in my town & has his car in the driveway. A couple years ago, or a bit more he moved out of state to his DDIL's (his son/ her DH passed away). He was living with her for 2-3 years & recently died, making the DDIL the power of attorney (she now owns his house & car with flat tires). A couple weeks ago she found that his previous neighbors called the cops to make her get rid of the car (it's been sitting there so 'bugs' them). John said the cops have to send a letter telling the SIL & if she doesn't respond they send another. If she still doesn't respond they (the cops) can have it towed then fine her. She doesn't even have the title (which is needed before a company tows, I bet not the police though). John will be home so we are going over to get in & see if the title is in the glove box or maybe in the house. Do you know what she can do? It's not her fault he moved & 'forgot' about his car for 2 yrs & also died, making her the power of attorney....but it's true, it is now her car.

I will be curious how this plays out! if the car is her property now & is sitting in her driveway I don't see how the cops can tow it off. don't those neighbor's have anything better to do than harrass a woman dealing with a death? shame on them! if there's a garage maybe push it in there after getting air in the tires?

What happens around here is, they check the inspection sticker and license, and if those are out of date, you usually get 30-60 days to fix that before the car is towed... But the lack of clear title may confuse that.
Other question is, is the DDIL the HEIR to the estate? Being given power of attorney doesn't make her heir so the question of responsibility could change from state to state. Heirs own it, but till will is probated and so on, the person with power of attorney can be held legally responsible that I know of. (Went through some of this BS with the Great Evil Auntie drama, and by the way, SHE is suing us AGAIN for $$ she says we ower her for her work as executor! Yet she never had the will probated, it didn't name her executor anyway, and she robbed the estate to the last penny! ACK!) Sorry, had to digress there...
Good luck figuring this out. If th eneighbors keep *****ing, just put a tarp over it, or a for-sale sign on it maybe?Dx: Epilepsy; depression; chronic GERD and peptic ulcer disease; pelvis and spine damage from accident.

Leo,Evil Auntie needs to get a life I'm thinking! no idea what the laws are re:probate but she could be in trouble herself if she failed to follow the law?

it's been interesting reading all the different laws around this country. seems to me cops would have more important issues to deal with than cars sitting in driveways.

Pati, yes to what you said about probate. It seems the laws are so screwy and not even close to each other. It seems to be different by the county around here. I don't remember having to do all the crap Ken is having to do with his Mom's will. Of course, brother and I let the lawyer work out all the snafu's. I see now it saved us a lot of grief. We had enough grief already. Siblings aren't anywhere helpful!!
I will be glad when it is all said and done. It is just keeping hubby in a stew. That causes me to stress out!! I'm still trying to get MIL's bedroom cleared out!!
Lor, good luck with finding the title. Poor thing, it seems you got it comming and going lately. Any luck with getting FIL settled? I do wish you the best of luck and find some peace and hopefuly find FIL a little peace too.

Jo,Ken should just hire a probate lawyer. my housemate does everything through the lawyer. supposedly his daughter's probate will be final next month. I try to brace him for the legal cost. he says he's paying every month,however from my experience with lawyer's they always charge twice what they claim it will be.
